CarBindr Terms of Service

1. Who you're dealing with

CarBindr is operated by James Millington, an individual doing business as CarBindr ("we", "us", "CarBindr"). These Terms are an agreement between you and him.

By creating an account or using CarBindr, you agree to these Terms and to the Privacy Policy. If you don't agree, don't use it.

2. Who can use it

You must be at least 18 years old. By using CarBindr you confirm that you are, and that you can enter into a binding agreement.

CarBindr is offered to residents of the United States. We don't currently support users elsewhere and make no claim to comply with other countries' laws.

3. Your account

You are responsible for your account and for keeping your password to yourself. Tell us at carbindrhq@gmail.com if you think someone else has got into it.

Give us an email address that works. It's how we send password resets and anything important — if it bounces, we can't help you get back in.

One person, one account. Don't share credentials or let someone else use yours.

4. Beta

CarBindr is pre-release software in beta testing. By using it you accept the following, which apply in addition to everything else in these Terms:

It is unfinished. Expect bugs, rough edges and behaviour that changes without warning. Features may appear, change or be removed entirely.
We intend to keep everything you enter. Our aim is that your account, your vehicles and your service history carry straight through to general release with nothing to re-enter and no account to remake. We will take reasonable care to make that happen, and we will not discard beta data for convenience.
We still cannot guarantee it. This is pre-release software running on infrastructure we are still building out. Data could be lost to a bug, a failed migration or a problem we have to fix by resetting something. If that ever becomes necessary we will tell you first and give you time to export — but please don't make CarBindr the only copy of anything. The PDF export in the Share panel exists for exactly this.
We will tell you when beta ends. Before CarBindr leaves beta we will email you to say what is changing, what happens to your account and your data, and whether there is anything you need to do.
There is no availability commitment. It may be down, slow, or offline for extended periods. There is no service level of any kind.
There is no support commitment. We will help where we can, at carbindrhq@gmail.com, but not on any timescale.
These Terms and the Privacy Policy will change before general release. We will notify you of material changes as described in section 18.
Feedback is ours to use. If you send us suggestions, bug reports or ideas, we may use them freely, without obligation, attribution or payment. You keep any rights you already had in them; you are simply not charging us for the suggestion.
Access may end. We may end the beta, or your access to it, at any time. If we do, we will give you notice and a chance to export your records first.

Beta participation is voluntary. If any of the above is unacceptable, please don't use CarBindr until general release.

5. What CarBindr is — and what it isn't

CarBindr is a record-keeping tool. It stores what you tell it about your vehicles and shows it back to you.

Please read this part properly:

It is not professional advice. Service schedules and reminders are derived from intervals you or we entered. They are a convenience, not a specification.
Your manufacturer's maintenance schedule always wins. Where CarBindr and your owner's manual disagree, follow the manual.
We do not inspect your vehicle and cannot know its condition. A vehicle showing "up to date" in CarBindr may still be unsafe to drive.
Reminders can fail to arrive. SMS depends on carriers and networks we don't control. Don't make safety-critical maintenance depend on them.
CarBindr is not a legal record of title or ownership. Storing a scan of your title here does not affect who legally owns anything.

You remain responsible for maintaining your vehicle. Deciding when to service it — and whether it is safe to drive — is yours alone.

6. Your content

Everything you put in is yours. Your vehicle records, service history, documents and photos belong to you. We claim no ownership.

You grant us permission to store, back up, display and transmit your content in order to show it to you, to include it in exports you generate, to share it with a shop when you create an invite code, and — only when you use the AI features — to send the specific images you select to Anthropic for reading.

You also grant us permission to use your vehicle and service information as described in the Privacy Policy, which reserves the right to collect analytics and to sell or share information with third parties. This does not extend to the contents of documents you upload — titles, bills of sale, insurance policies and tax documents are never sold or shared, in any form.

This permission ends when you delete the content or your account.

You confirm you have the right to upload what you upload, and that doing so doesn't infringe anyone else's rights.

7. Acceptable use

Don't:

Upload anything unlawful, or anything you have no right to.
Try to reach another user's data, or probe, scan or attack the service.
Automate account creation, or scrape the service.
Resell or redistribute CarBindr as your own.
Deliberately submit false records to deceive someone — for example, to misrepresent a vehicle's history to a buyer.

That last one matters: people may make purchase decisions on the strength of a maintenance record. We may suspend or close accounts for any of the above.

8. The AI features

CarBindr can read a window sticker or a receipt photograph and pre-fill a form.

The output may be wrong. It misreads things. Check it before you save.
Nothing is saved without you. Every extraction is a draft you review.
Selected images are sent to Anthropic to be read. See the Privacy Policy.
These features depend on a third-party API and may be unavailable, rate-limited, changed or withdrawn.
They are subject to fair-use limits so a small number of people can't exhaust the capacity for everyone.

You can generate a code giving a shop access to one vehicle's history, so they can read it and log work.

You choose to do this. We never share your records with a shop otherwise.
Codes expire — 72 hours by default, never more than 7 days.
You can revoke access at any time, and it takes effect immediately.
A shop that logs work becomes the author of those entries. We don't verify what they write, and we aren't responsible for its accuracy.

10. SMS reminders

If you turn on SMS reminders:

You consent to receive automated text messages at the number you give us.
Message and data rates may apply — your carrier's charges are yours.
Reply STOP to any message to stop them, or HELP for help. You can also turn them off in the app.
Frequency depends on the schedule you set.
Delivery isn't guaranteed.

You confirm the number is yours and that you may receive texts on it. If it changes, update or disable it — otherwise we may be texting a stranger.

11. Paid plans

The following applies once paid plans are available. CarBindr is currently free. We will give notice by email before charging you for anything you use for free today.

When paid plans launch:

Fees, billing frequency and what's included will be stated at sign-up.
Subscriptions renew automatically until cancelled.
Cancel any time from your account; you keep access until the end of the period you've paid for.
Fees already paid are non-refundable except where the law requires otherwise, or where we have obviously failed to provide the service.
We'll give at least 30 days' notice by email before a price change, and you may cancel instead.
If a subscription lapses you keep access to your data and can still export it, even if paid features stop.

We use a third-party payment processor. We never see or store your full card number.

12. Availability

We'd like CarBindr to be up all the time, but we don't promise it. It may be unavailable for maintenance, for reasons outside our control, or because something broke.

We do not guarantee against data loss. We take backups and take care, but you should keep your own copies of anything important. The PDF export in the Share panel exists for exactly that — use it.

13. No warranty

CarBindr is provided "as is" and "as available", without warranties of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We don't warrant that it will be uninterrupted, error-free, or that its records, reminders or AI output will be accurate or complete.

14. Limitation of liability

To the fullest extent the law allows:

We are not liable for indirect, incidental, special, consequential or punitive damages — including lost profits, lost data, vehicle damage, or costs arising from a missed service.
Our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50.

Some states don't allow these exclusions, so parts may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.

15. Indemnity

You agree to indemnify us against claims arising from your content, your use of CarBindr, or your breach of these Terms.

16. Ending it

You can stop at any time. Delete your account from inside the app — it removes your vehicles, records, documents and photos. That can't be undone, so export first if you want a copy.

We may suspend or close your account if you materially breach these Terms, if we are required to by law, or if we stop operating CarBindr. Except where you've seriously breached these Terms, we will give you at least 30 days' notice and a chance to export your data before closing your account.

Sections 6, 13, 14, 15 and 17 survive.

17. Governing law

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts located in Norfolk County, Massachusetts, and both of us consent to that.

No arbitration clause and no class-action waiver are included. Both are common, and both are worth discussing with a lawyer — an arbitration clause drafted badly is worse than none at all.

18. Changes

We may update these Terms. We'll change the date above, and for material changes we'll email you before they take effect. Continuing to use CarBindr afterwards means you accept them. If you don't, stop using it and delete your account.

19. Everything else

Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about CarBindr.
Severability. If a provision is unenforceable, the rest stands.
No waiver. Not enforcing something once doesn't waive it.
Assignment. You may not assign these Terms. We may, on notice, if the business transfers.
